Declaration of Dongsha Atoll Environmental Protection

In order to enhance the conservation of Dongsha Atoll NationalPark and to restrain illegal activities of foreign fishing boats, Kaohsiung City Hall, Coast Guard Administration, Kaohsiung District Prosecutor´s office and Marine National Park Headquarters (MNPH) inaugurated the bulletin of prohibited species and co-organized the "Declaration of Donsha Atoll Marine Environmental Protection" on July 5, 2016. Deputy Mayor, Mr. Chin-de Chen attended the declaration in person. 32 other guests participated in this ceremony, including Attorney General Zhi-yu Yang, Chief Prosecutor Qing-zong Lin and Prosecutor Zhong-xiaoZhong from Kaohsiung Branch- Taiwan High Prosecutors Office, Chief Prosecutor Cong-rongSu and Chief Prosecutor Feng-qi Gao from Kaohsiung District Prosecutors Office, Chief Jin-ding Li from Qiaotou District Prosecutors Office, Director Nai-dan Xu Deputy Director and Tian-hou You from the Legal Affairs Bureau of Kaohsiung City Government, Deputy Director Shang-yuKe from the Marine Bureau of Kaohsiung City Government, Deputy Director-General Qing-qinXie from the Maritime Patrol Directorate General of Coast Guard Administration, Director Yong-junTeng from the Southern Coastal Patrol Office, Coast Guard Administration, Captain Chao-qing Yang from the Fifth Coastal Patrol Unit of Coast Guard Administration, Director Teng-Lang Yu from the MNPH and Investigator Zhao-lun Chen from Academia Sinica. The ceremony began with the inauguration. The next highlight was releasing the sea turtle captured by illegal fishing boats on the beach. Simple but serene, the event ended at the national monument.

On March 23, 2016, when the Coast Guard Administration of Executive Yuan and MNPH were enhancing law enforcement at sea, they discovered that a steel vessel, "Qiong-qiong Hai-yu 05055", registered in Mainland China, was illegally extracting coral, capturing and dissecting green turtles, which are protected species. Their act was a huge threat to the eco-system in the national park. In addition to escorting the fishermen to Taiwan, the Kaohsiung District Prosecutors Office prosecuted those involved in the case based on the law. This has a deterrent effect to those fishing boats that cross border without permision and engage in illegal activities.

Dongsha Atoll is under the jurisdiction of Cijin District, Kaohsiung City. To prove the government´s resolution on protecting the marine resources around Dongsha Atoll, the Kaohsiung City Government announced that, based on the restriction or prohibition of the catching, harvesting, or processing of aquatic organisms of the Item 1, Paragraph 1, Article 44 of the Fisheries Act, in the waters within the boundary of Dongsha Atoll´s territorial sea, if not for the purpose of experiment, research and resource investigation, capturing or extracting the following species is prohibited: (1) All kinds of coral and coral reef; (2) Giant clams (Tridacnagigas); (3) Trochidae; (4) Tripneustesgratilla; (5) Charoniatritonis; (6) Sea cucumbers; (7)Chondrichthyes, and other animals. The violators, according to the Paragraph 2, Article 60 of the Fisheries Act, "shall be subject to imprisonment not exceeding three years, short-term imprisonment, or in lieu thereof or in addition thereto a fine of not exceeding one hundred and fifty thousand New Taiwan Dollars". This will not only serve as the foundation for enhancing law enforcement, but also deter violators in the future. With the joint inauguration ceremony, the authorities not only declared the sovereignty of the territory, but also warned illegal parties interested in the resources around Dongsha Atoll with strict law enforcement and severe punishment so that they won´t take their chances and violate the law.
